3. Account Registration and Security

  • Notify us immediately of any unauthorized use
  • Take responsibility for all activities that occur under your account

You are solely responsible for safeguarding your password and for all activities that occur under your account. We cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.

We strongly recommend enabling two-factor authentication (2FA) for your account. Use a strong, unique password and never share your login credentials with anyone.

4. Our Services

4.1 Service Description

NexaHost provides web hosting services, domain registration, VPS hosting, dedicated servers, and related services. We strive to provide reliable, high-performance hosting solutions.

4.2 Service Availability

We aim for 99.9% uptime on all our hosting services. However, we do not guarantee that our Services will be uninterrupted, timely, secure, or error-free. We may perform maintenance, repairs, or upgrades that may temporarily affect availability.

4.3 Modifications to Services

We reserve the right to modify, suspend, or discontinue any part of our Services at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

5. Payments and Billing

5.1 Fees and Charges

By purchasing our Services, you agree to pay the fees specified at the time of purchase. All fees are non-refundable except as expressly provided in our Refund Policy.

5.2 Billing Cycles

Services are billed in advance on a monthly, quarterly, yearly, or biennial basis depending on your selected plan. You will be charged on each renewal date until you cancel your subscription.

5.3 Payment Methods

We accept major credit cards (Visa, MasterCard, American Express), PayPal, and bank transfers. By providing payment information, you represent that you are authorized to use the designated payment method.

5.4 Late Payments

If your payment method fails or your account is past due, we may:

  • Suspend or terminate your Services
  • Charge a late fee of 15% per year (whichever is greater)
  • Require payment in full before reactivation

6. Refund and Cancellation Policy

6.1 Money-Back Guarantee

We offer a 30-day money-back guarantee on all shared hosting and VPS hosting plans. If you cancel within the first 30 days of service, you will receive a full refund (excluding domain registration fees, add-ons, and setup fees).

6.2 Non-Refundable Items

  • Domain registration and transfer fees
  • SSL certificates
  • Add-on services and professional services
  • Setup fees
  • Services canceled after 30 days

6.3 Cancellation Process

To cancel your services, you must submit a cancellation request through your client area. Cancellation requests must be received at least 48 hours before your next billing date to avoid charges.

Domain Refunds

Domain registrations and transfers are non-refundable. If you cancel hosting within 30 days, you may keep the domain but will be charged the standard domain registration fee.

7. Acceptable Use Policy

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to:

7.1 Permitted Use

  • Personal websites and blogs
  • Business websites and e-commerce stores
  • Application hosting and development
  • Email hosting and communication
  • Backup and storage (within reasonable limits)

7.2 Resource Usage

Shared hosting plans are subject to fair use policies. You may not:

  • Use excessive CPU, memory, or disk I/O that impacts server performance
  • Use shared hosting for dedicated server-like applications
  • Host file sharing or backup repositories exceeding 10GB
  • Run cron jobs more frequently than every 5 minutes

8. Prohibited Activities

The following activities are strictly prohibited on our Services:

Spam & Email Abuse

Sending unsolicited bulk email, email bombing, or using our services for email marketing without proper opt-in consent

Copyright Infringement

Hosting or distributing copyrighted material without permission (torrents, warez, pirated software)

Malicious Activity

Phishing, malware distribution, DDoS attacks, hacking tools, or any form of cyber attacks

Illegal Content

Child pornography, illegal drugs, weapons, gambling (where prohibited), or any content illegal in your jurisdiction

Crypto Mining

Cryptocurrency mining, botnets, or any form of resource exploitation without explicit written permission

Proxy/Anonymizers

Running public proxy servers, VPN services, or anonymizing services on shared hosting plans

Zero Tolerance Policy

We have a zero-tolerance policy for prohibited activities. Violations will result in immediate account suspension without refund and may be reported to appropriate authorities.

9. Service Level Agreement (SLA)

9.1 Uptime Guarantee

We guarantee 99.9% network and power uptime for all hosting services. Uptime is calculated on a monthly basis, excluding scheduled maintenance (notified at least 24 hours in advance).

9.2 Credits

If we fail to meet the 99.9% uptime guarantee, you may request a credit:

  • 99.0% - 99.9%: 10% credit of monthly fee
  • 95.0% - 98.9%: 25% credit of monthly fee
  • 90.0% - 94.9%: 50% credit of monthly fee
  • Below 90%: 100% credit of monthly fee

9.3 Exclusions

SLA credits do not apply to outages caused by:

  • Scheduled maintenance with prior notification
  • Customer applications, scripts, or configurations
  • DDoS attacks or third-party service interruptions
  • Force majeure events
  • Violations of Acceptable Use Policy

10. Termination

10.1 Termination by You

You may terminate your account at any time by submitting a cancellation request through your client area. Services will remain active until the end of your current billing period.

10.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including:

  • Violation of these Terms
  • Non-payment of fees
  • Prohibited activities or illegal use
  • Request by law enforcement or government agency

10.3 Data Retention

Upon termination, we may delete your account data and files. We recommend you maintain backups of your data. We are not responsible for data loss upon termination.

Backup Policy

We perform daily backups for your convenience, but these are not guaranteed. You are solely responsible for maintaining independent backups of your data. We recommend downloading local copies of important files.

11. Limitation of Liability

To the maximum extent permitted by law, NexaHost shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use our Services
  • Any conduct or content of any third party
  • Any content obtained from our Services
  • Unauthorized access, use, or alteration of your transmissions or content

Our total liability to you shall not exceed the amount paid by you during the twelve (12) months prior to the event giving rise to the liability.

No Liability for Content

We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any content or communications posted via our Services. You acknowledge that any reliance on such content will be at your own risk.
